HARARE Magistrate Nomsa Sabarauta on Wednesday 18 January 2017 set free five pro-democracy campaigners who were arrested last year and charged with committing robbery and theft after they allegedly robbed some women at Africa Unity Square.

Magistrate Sabarauta removed the five pro-democracy campaigners namely Patson Dzamara, Oliver Chikumba, Tatenda Mombeyarara, Pride Mkono and Makomborero Haruzivishe from remand after granting an application for refusal of further remand filed by the human rights activists’ lawyer Obey Shava of Zimbabwe Lawyers for Human Rights (ZLHR).

In his application, Shava had argued that State witnesses had never attended a single court case and hence were fitictious.

Magistrate Sabarauta advised prosecutors to proceed by way of summons if they intend to pursue the matter.

Dzamara, Mkono, Haruzivishe, Chikumba and Mombeyarara were arrested in June 2016 and charged with committing robbery and theft after they allegedly robbed some women as they staged a protest in Africa Unity Square.

Meanwhile, Harare Magistrate Vongai Muchuchutu will on Thursday 19 January 2017 deliver her ruling on an application filed by Remnant Pentecostal Church Pastor Phillip Patrick Mugadza challenging the lawfulness of his arrest and detention.

Pastor Mugadza’s lawyer Gift Mtisi of ZLHR argued that the clergyman’s constitutional right to be brought to court from police cells within 48 hours had been violated as he was only hauled to court after 51 hours.

Pastor Mugadza was arrested on Monday 16 January 2017 and charged with contravening Section 42 (2) of the Criminal Law (Codification and Reform) Act Chapter 9:23 alternatively criminal nuisance as defined in Section 46 (2) (v) of the third schedule to the Criminal Law (Codification and Reform) Act Chapter 9:23.

Prosecutors charged that Pastor Mugadza caused the publication of a story in an online publication, The Zimbabwe Mail on Friday 13 January 2017 entitled “Pastor Mugadza says President Mugabe to die in October 2017, thus says the Lord”.

Mtisi also argued that Zimbabwe Republic Police (ZRP) officers had employed some guerrila tactics after they compelled Pastor Mugadza to sign a new warned and cautioned statement in the absence of his lawyer.

According to prosecutors, Pastor Mugadza allegedly insulted the Christian religion and the African traditon by uttering some words which are a taboo to predict someone’s death and words to the effect that; “It was on the 26th December 2016 when I was in prayer and God said to me this coming 2017 the President is dying and he told me that he is dying on 17 October 2017, like I said earlier on that am not happy for someone to die but this is something that is going to happen. People may ask me if what he does not die. I do not know how much he believes in prayer but he has to do something about this prophecy”.

Inspiring Quotations

"The determined efforts, and spirited focus by Zimbabweans from all paths and circles of life against authoritarianism as epitomised by #Tajamuka, #ThisFlag, churches, political parties, individuals etc just transmits a 'zing' of confidence, hope and dawn of a new dispensation from my skull nerves to my balls right to the tip of my foot. Authoritarianism and the despotic dispensation are under electrocution."
- Adolf, Kubatana subscriber in reply to our question asking what keeps people inspired during these tough times
" It was good and permissible when the flag since 1980 was carried by every Harry and Tom to Rufaro Stadium or National Sports Stadium to support Zimbabwe's national team the Warriors. It is good and permissible when the flag is carried about by women and children flocking to the airport to routinely receive the President from his many foreign travels. It is good and permissible if the flag is mutilated and redesigned on the party regalia of the country's self-acclaimed LIFE RULING SINGLE PARTY. It is now bad and not permissible when it is carried by those who demand that the sacrifices of those who lost their lives and years in the liberation struggle be respected by those in power through fighting corruption; practising good governance; public accountability by bringing to book those who are responsible for the missing $15 billion diamond revenues; fiscal austerity by cutting down on the many annual trips the President embarks on; by cutting on extravagance through avoiding the purchase of expensive Range Rovers when the govt is very broke to the point of asking for financial help from those it says are destabilising the economy and country."
